The judgments recognised that native title can displace existing titles in certain situations, but there is complete confusion and a lack of certainty about how this may take place. The consequence is that many pastoral, mining and may be even residential titles, particularly in Western Australia, are in doubt.

The consequence is a moratorium on all economic development.No company or individual will in any way develop their property if there is the slightest doubt about title and possible burdens on the land. Economic development will be at a standstill to the detriment of the entire nation.
